DWI Attorney in Montgomery County

Trial-Tested DWI Defense for Criminal Charges & License Concerns

A DWI arrest can create two separate legal matters: a criminal DWI case and an Administrative License Revocation (ALR) matter involving your driving privileges.

At Jeremy S. Dishongh Law Offices, we help people facing DWI allegations understand the paperwork, deadlines, testing evidence, court notices, and immediate concerns that follow an arrest. Whether you’re worried about getting to work, caring for family, protecting your license, or understanding what happens next, we provide direct guidance based on the facts of your case.

Texas DWI allegations can involve a traffic stop, field sobriety testing, breath or blood testing, officer observations, and recordings from dashcams or bodycams. Our attorneys review the circumstances of the arrest and explain the available legal options without making promises about a particular result.

DWI Defense Backed by Experience Since 2005

Jeremy S. Dishongh, our founder, brings a background as a former probation officer. Since 2005, we have represented Texans in criminal-defense matters, and our trial-tested lawyers have secured multiple Not Guilty jury trial verdicts in DWI cases.

We communicate respectfully and in clear language, serving clients in English and Spanish.

DWI Evidence Review in Montgomery County

We begin by reviewing the facts of the arrest, the charging allegations, and the evidence available in your case. The legal issues that matter can vary based on the reason for the traffic stop, the officer’s observations, testing procedures, and your prior record.

Our DWI defense attorneys review police reports, testing results, and procedures from your arrest. We can examine dashcam and bodycam footage, officer certification records, breath-test calibration and maintenance logs, and blood-sample chain-of-custody documentation. A careful review can also address whether field sobriety testing was administered properly and whether the records support the conclusions asserted by law enforcement.

Evidence questions we review:

  • Traffic Stop: The stated basis for stopping your vehicle and the officer’s documentation.
  • Field Sobriety Testing: The instructions, conditions, observations, and administration of roadside tests.
  • Breath and Blood Testing: Test procedures, certification records, calibration, maintenance, and sample handling.
  • Video and Reports: Dashcam and bodycam evidence, written reports, and the consistency of the officer’s account.

We prepare each case for negotiation or trial, depending on whether a negotiated resolution serves your interests. Our role is to explain the evidence, identify issues requiring attention, and help you decide how to proceed with a clear understanding of the risks and options.

Factors That Can Affect a Texas DWI Charge

The applicable charge, possible penalties, license consequences, and defense options depend on the facts and current Texas law. Relevant considerations can include a prior intoxication-related conviction, an alleged accident or injury, a child passenger, the reported alcohol concentration, a test refusal, and the completeness of the officer’s investigation.

Under Texas Penal Code Section 49.04, DWI is generally charged as a Class B misdemeanor and carries a minimum 72-hour confinement term. However, allegations involving prior convictions, a child passenger, injury, death, or other circumstances can change the level of the charge and potential punishment. We represent clients facing first-time DWI allegations as well as more serious felony charges.

Practical concerns also matter, such as whether you rely on your license to reach job sites, care for family members, or attend school and medical appointments. We talk through how the case and any license action may affect your day-to-day responsibilities. We also discuss immigration-related concerns when they are relevant, because the consequences for a noncitizen can depend on individual legal circumstances.

The Criminal Case & Administrative License Revocation Process

The criminal DWI case and the ALR matter are separate. The criminal case concerns the DWI charge, court appearances, and potential criminal penalties. Administrative License Revocation concerns driving privileges and is handled through an administrative process involving the Texas Department of Public Safety and, when a hearing is requested, the State Office of Administrative Hearings.

For many suspension notices, Texas DPS requires an ALR hearing request within 15 days after the notice is served. Blood-test cases can involve a later notice with a different request period. The notice you receive controls, so it’s important to have the paperwork reviewed promptly rather than assuming the criminal court date protects your license rights.

We can request and represent clients at ALR hearings and walk you through the arrest paperwork, court information, testing evidence, and license concerns. Our review may include officer procedures and relevant certification records, along with the notice and evidence connected to the alleged license suspension. An ALR hearing has its own procedures and isn’t the same as resolving the criminal DWI charge.

Courts in Montgomery County can set hearings on schedules that require timely attention. We explain the purpose of each setting, prepare you for required appearances, and evaluate whether negotiation or trial is appropriate based on the evidence and your priorities. If a case proceeds to sentencing, the available consequences and requirements depend on the charge, court rulings, and case-specific facts.

Clear Support for Work, Family & Language Needs

A license suspension or restriction can affect transportation to work, caregiving, school, medical appointments, and other daily responsibilities. We discuss these concerns with you early so they are part of the legal strategy and decision-making process. An occupational license, which is a restricted license that may allow driving for essential needs, may be an issue to discuss depending on your circumstances and the applicable legal requirements.

At Jeremy S. Dishongh Law Offices, our bilingual team provides support in English and Spanish, explains legal steps in plain language, and responds respectfully to the concerns that matter most to you. We also offer virtual consultations for clients who need a remote option to discuss their case.
